3.2 Purchase guarantee

Every product in our web site has the following data:

– Image/s of the product.
– Brief description of the item.
– Sizes and colors available.
– washing instructions.
The special offers, promotions or discounts will be valid until the given date or end of stocks lasts.
In the same vein, The Gueko Company makes the necessary efforts to provide a complete accurate and truthful information. Should there be any mistake, The Gueko Company would undertake the necessary adjustments.
The legal guarantee of the products offered by The Gueko Company is the one established in the royal decree 1/2007 nov. 16th by which the recast text of the law in defense of consumers and users is approved.
The Gueko Company will satisfy any complaint expressed in two years time from delivery date.
3.3 Purchase procedure
1. The items to be acquired should be selected and added to the shopping cart by clicking the correspondent icon.
2. The shopping cart will include the reference, size color and price in the correspondent currency (taxes included). The shown price does not include transport which rates will vary depending on the shipping method selected.
4. Once fulfilled the purchase order, and before confirmation, the user will be presented a summary of the referenced order item, its total price ( transport and taxes included) with each concept specified and the shipping data for the user to confirm by clicking the “ confirm payment” button.
The purchases can be paid with credit or debit cards ( Visa, Visa electron, Mastercard). Other than the specified in this terms of sales ways of payment will not be accepted. The payment will be on line , meaning, at the time of clicking, via the bank’s payment platform, once the user’s data have been accepted.
In addition, an automatic electronic confirmation message will be sent to the provided address describing the order and personal data to receive the parcel. Not receiving this message may be due to a temporary communications problem, or to a error in the writing of the address provided.
3.4 Availability of products
All orders are subject to availability. If, at the time of purchasing the item there is none in our stock, The Gueko Company will try to find it, and it that is not possible, the user will be notified immediately and the cost of the item charged but not sent will be refunded the same via it was charged.
3.5 Right not to accept and order or to cancel an order.
The Gueko Company may cancel an order or not accept a confirm order if:

The Gueko Company will entirely refund the amounts which had been already paid, once discounted the shipping expenses.
PRICE AND PAYMENT
4.1. Payment and currency.
Prices in this website are shown in euros.
4.2. According to the VAT law, The Gueko Company is obliged to include this tax in all items delivered in Spain except Canary Islands, Ceuta and Melilla.
In purchases delivered in Canary Islands, Ceuta and Melilla the taxes to be applied will be the ones according to the, at the time, existing regulation in these territories.
4.3. Method of payment.
The Gueko Company will only accept payment made through the following methods:
-Payment with credit or debit card: The Gueko Company accepts payment for the products acquired in its website with these credit/ debit cards: Visa, Visa electron, Mastercard.
In this case the charge will be made on line, through the corresponding payment gateway once the info supplied is verified.
4.4. Payment security
In order to provide maximum security to the payment method, The Gueko Company uses first-rate financial companies in e-commerce. Accordingly, the payment confidential data is transmitted directly and encrypted (SSL) to the corresponding financial company. The Safe e-commerce is an initiative which basic principle is to guarantee the security in internet transactions. When paying through the secure payment gateway, the system will verify automatically that the credit card is activated for Secure e-commerce. Next, it will connect with the cc issuing bank which will require transaction authorization through a personal authentication code. The shipping of the items purchased at iroiroart.com will be made through a courier company and will be delivered in Spain in a approximate term of 7-10 working days.
-Spanish peninsula and balearic islands will have free delivery if the quantity purchased is over 90€, if less than this amount the charge will be 5.50€.
-Canary islands, free if quantity purchased is over 150€, if less than this charge will be 9.00€.
-Europe, delivery will be FREE of charge if purchased over 150€, if less, the charge will be 9.90€.
-Africa, FREE delivery if purchase is over 200€, if less , charge will be 15.00€.
-Asia and Oceania, delivery charge will be 15.00€. If purchased over 200€ FREE delivery.
The delivery charge is the same for all selected items and it will be shown in the resume page before customer’s order confirmation by clicking the “confirm payment” button and before introducing payment info.
The delivery charges may be change without previous notice. Such changes will be applicable from the moment in which the modification is included in the contract and in the help pages.
In any case, valid delivery charges will be those shown at the time of making the order.
RETURNS AND EXCHANGES POLICIES
6.1. Exchange and Return
If once received the product if customer is not satisfied, The Gueko Company allows the exchange or return of it within a period of thirty (30) days, from the date of reception, provided that the item has not been used or damaged and it is in a perfect condition. Therefore, The Gueko Company will not accept exchanges or returns of items used or damage ( as long as the damage is not a production defect).
In order to exchange an item, first, it should be returned, and then, purchased again.
Every returned item should be carefully packed and include the delivery note or the return form duly completed.
In the event of not having this form at the time of exchanging or returning, the customer shall download it accessing the order detail page available at www.iroiroart.com
6.2. Exchange or return at the shop.
All shown in the website are all available at the physical shop, so they can be exchanged or returned there as well.
6.3. Exchange or return by postal mail.

The shipping expenses of the items intended to be returned should be undertaken by the customer and in any case The Gueko Company will accept return items freight collect.
6.5. Right of withdrawal.
The customer has the right to withdraw from the present contract in a 14 natural days period without any need of justification.
The term for withdrawal expires in 14 natural days from the purchasing the items day. To use this right is necessary to notify us the decision to withdraw from this contract in a unambiguous statement to:

To comply the term of withdrawal it is enough with sending the notification before the end of the correspondent term.
Consequences of the withdrawal.
In the event of a withdrawal, we will refund all payments received after the purchase including the shipping expenses ( with the exception of those shipping methods with extra expenses selected by the customer different from the less expensive of ordinary delivery offered)with no undue delay, and in any case, in a maximum of 14 natural days from the date we are notify the withdrawal from this contract. The refund will be made through the same method the purchase was mede, unless otherwise specified by the customer. In any case there will not be any expenses as a result of the return, except the ones generated by the shipping should there be any.
We may hold the refund until we receive the items or the customer presents a proof of the devolution.
The customer should restore the items without undue delay and in any case in a maximum of 14 natural days from the date we were notified the intention of withdrawal from the contract.
In order to return the items the customer may use the services The Gueko Company offers: free in-shop return and post return which expenses he should undertake.
Once received the returned products The Gueko Company will check their correct condition and proceed to send the new size if an exchange is needed or the refund of the money if item is returned.
Time for refund will be a maximum of 10 working days from the moment the item is received by The Gueko Company, once verified the correct state of the products. Customer will be properly informed.
In the event of using the right of withdrawal from the purchase order, the maximum term for refunding will be 14 natural days from the withdrawal.
The refund will always be made through the same method payment was made.
In the event The Gueko Company has sent by mistake a different item than ordered or the quality of the item is not proper, The Gueko Company, once verified the mistake or the defect, will refund the amount of the item returned and the delivery expenses.
In the case an item with error or defect was returned by post, The Gueko Company will refund the sending expenses as long as the customer includes in the parcel the receipt of the return expenses.
The refund of the transportation expenses will be made after the one of the items.
The info provided by customer at the time of registering will be used by The Gueko Company only to process the orders and ease the navigation and purchasing at the website. In addition to this, and only if customer accepts, The Gueko Company will inform him/her via e-mail of the new products and special offers.
